
UditVani, Jamshedpur : Congress MP Rahul Gandhi today received major relief from the Jharkhand High Court, which quashed the cognizance order issued against him by the Chaibasa Civil Court in a criminal case.
The High Court has also remanded the matter back to the lower court for reconsideration.
A single bench of Justice Anil Kumar Chaudhary observed that the order of cognizance taken by the lower court was influenced by the intervention of the Sessions Court, which was not legally appropriate.
The court ruled the cognizance order as “legally unsustainable” and set it aside.
The case stems from a complaint filed against Rahul Gandhi, alleging criminal charges.
Initially, the magistrate had dismissed the complaint.
However, the complainant later filed a revision petition before the Sessions Court.
During the pendency of that revision, the magistrate reconsidered the matter, took cognizance, and issued summons against Rahul Gandhi — an action subsequently upheld by the Sessions Court.
Representing Rahul Gandhi, advocate Dipankar Rai argued that the entire process was contrary to the established legal procedure and amounted to a violation of judicial propriety.
The High Court accepted this argument and quashed the cognizance order, granting significant relief to the Congress leader.
